The “metadata debate”: A Latin American Perspective

SourceIn recent years, especially after the Snowden revelations, a legal debate on metadata has sparked, primarily in the United States. In essence, what the legal scholars and US government officials have been arguing is, first, whether communications metadata deserves the same protection as the content of communications, and second, whether, in any case, the collection of metadata alone constitutes an interference with the right to privacy or whether the analysis of such data would be necessary to raise the question. This article provides a Latin Perspective on the metadata debate.
